Terms of service

These terms govern the Qoretix website, public materials, and demo/onboarding requests provided by IXC Co., Ltd. (IXC). Qoretix is IXC's quality validation, security, production monitoring, and Managed QA offering, not a separate legal entity. Paid work is governed by a separate statement of work (SOW) or contract.

1. Purpose and scope

These terms apply to website use, including browsing, public materials, and demo/onboarding requests. If a separate contract conflicts with these terms, that contract prevails for the paid work. Mandatory law takes precedence.

2. Service status

Qoretix is in a pre-launch stage. Features, delivery methods, schedules, and pricing may change. Website descriptions and consultations are not binding offers or quotes. Paid work begins only when IXC confirms a written quote or contract.

3. Consultation requests

You must provide accurate, lawful information. IXC may decline requests because of scope, schedules, conflicts of interest, capacity, or legal/security reasons. Submitting a request does not establish a booking or paid engagement.

4. Confidential information and submission restrictions

Before a separate NDA or service agreement is signed, do not send source code, passwords, API keys, government identifiers, payment details, health information, or other sensitive or confidential information through the request form. Security, retention, and deletion conditions for test data, accounts, code, and materials will be agreed in writing before test access.

4A. Security, data processing, NDA, and DPA

IXC provides mutual NDAs and data processing addenda (DPAs) as needed. Access rights, processing locations, retention, return/deletion, and incident notification for environments, accounts, data, and evidence are agreed in a separate SOW or contract before actual test access.

5. Test results and release recommendations

  • Individual case results use passed, failed, inconclusive, and skipped states.
  • Release verdicts use PASS, CONDITIONAL, and FAIL, distinct from case-level results. CONDITIONAL requires human review and is not a pass.
  • No result or recommendation guarantees defect-free or uninterrupted operation, security, compliance, certification, or business outcomes.
  • Recommendations may no longer apply after changes to code, requirements, data, dependencies, infrastructure, or environments.
  • The client owns the final release decision. Findings must not be quoted without their exclusions, untested areas, residual risks, and assumptions.

6. Your responsibilities

You are responsible for final release and operational decisions, backups, security controls, legal/regulatory review, user notices, and required approvals. Provide accurate scope and a testable environment, and manage changes made after a verdict.

7. Prohibited conduct

Prohibited conduct includes breaking laws, infringing rights, transmitting malware, exploiting vulnerabilities, excessive automated requests, bypassing access controls, disrupting service, submitting false information, or altering or misrepresenting Qoretix verdicts, signatures, or marks. IXC may restrict access to protect safety and rights.

8. Intellectual property

Website brands, designs, text, templates, software, and materials belong to IXC or their lawful owners. Except for expressly permitted downloads and ordinary links or quotations, do not reproduce, distribute, modify, sell, or use them as trademarks without prior written consent. Rights to paid deliverables and user materials are defined by the relevant contract.

9. Third-party services and links

The site may include third-party hosting, CDN, email, and external links. Those providers' terms apply to their services. IXC is not liable for interruptions or changes beyond its control except as required by mandatory law.

10. Availability, changes, and suspension

IXC may change or suspend the site or features for maintenance, security, incidents, legal requirements, or operational needs. We make reasonable efforts toward reliable operation but do not guarantee continuous availability of the public site.

11. Limitation of liability

Nothing limits liability that cannot legally be limited, including willful misconduct, gross negligence, personal injury, or consumer protections. Otherwise, to the extent permitted by law, IXC is not liable for indirect, special, or consequential damages or loss of data or profits arising from free website use. Liability for paid services is governed by a separate contract.

12. Personal information

Personal information is governed by the Privacy Policy.

13. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Korea. Parties will consult in good faith to resolve disputes. Unresolved disputes are subject to the courts with jurisdiction under Korea's Civil Procedure Act.

14. Languages and amendments

These terms are available in Korean, English, and Japanese. If a translation conflicts with Korean, the Korean version prevails to the extent permitted by law. Material changes will be announced before taking effect, and the effective date and version updated above.
